CallFreak is a phone service providing you the cheap rates of international calling without the need to change long distance carriers. CallFreak’s long distance services can be used with your home phone, cell phone and with any other private touch-tone phones. Your flat domestic rate will vary depending on the calling plan you choose. A valid credit card is required to acquire service. U.S. credit cardholders only. Monthly service fee(s) will be deducted from the calling plan balance upon purchase of the long distance calling plan. Government mandated taxes and fees may apply. FCC mandated payphone surcharges may apply.
Provisions and Billing of Service: Service is provided and billed on a monthly basis, for a minimum period of one month. The start of service date is the date on which the customer accepts CallFreak’s service. Usage charges for services are billed in arrears and fixed monthly recurring and non-recurring charges are billed in advance. All applicable local, state and federal taxes and surcharges will be applied to bills.
Customer Obligations: Payment Policy: Customer understands that payments are due in full upon receipt of the billing statement unless an additional period for timely payment is required by law, in which case the full period required by law shall apply. A late fee will be added if payment does not arrive within 30 days after the billing date. Customers with Intrastate-only overdue balances will be subject to the appropriate late fee allowed by their state law. Service may be terminated if full payment is not received within 35 days after the billing date. For customers paying their bill by credit card, service will be suspended immediately upon notification that the credit card on file is declined or otherwise unchargeable due to expired information, fraud, chargebacks or other such problem types. If termination is required, ALL services will be deactivated and a termination fee will be added to the balance due. Customer further agrees to pay any and all costs associated with enforcing this agreement, including but not limited to reasonable attorney and collection fees, court costs, and costs of appeal. An administrative fee will be added to the balance to place the account into collections. In the event that any payment is returned, disputed, insufficient or otherwise unpaid by the customer's bank, Customer understands CallFreak will charge the cost of the processing fee from the bank. Customer must provide CallFreak’s notice of any disputed charges in writing within 30 days after the bill for such charges is rendered. Customer remains financially responsible for all charges incurred until such time as service to any telephone line(s) has been removed from the CallFreak network by CallFreak’s underlying carriers, and until written notification of the removal request from customer has been received by CallFreak. If CallFreak is designated as Customer's Primary carrier, customer must contact their local exchange company for cancellation and will be responsible for payments of all charges incurred prior to activation of a new primary carrier. Customer holds CallFreak blameless and assumes full responsibility for any and all calls, authorized or unauthorized, that are placed via customer's subscribed equal access lines and/or toll free lines. Customer is also financially responsible for all data customer enters into the sign up form, e-bill site and verbal or written correspondence to CallFreak, including incorrect information and telephone lines. Customer understands that their local telephone company may assess a service charge for each line changed to the carrier selected by CallFreak for which customer will be responsible. Customer understands that all rates, plans, billing increments, taxes and service fees are subject to change without notice. This includes federal and state Universal Service Fund (USF) surcharges, mandated by the FCC and subject to quarterly changes. CallFreak charges a Telecom Infrastructure Fee (TIF) that is also subject to quarterly changes. Federal and state taxes may change at the discretion of the taxing authority and without notice. CallFreak makes every effort to update its website with regard to such rates and fees when changes occur; however, this information is not always current. Customer understands that if they encounter an increase in rates and fees that are in conflict with the information posted on our website, our current internal price list, government notification or state tariff, if applicable, will govern rather than the website information. A current price list for all rates is always available upon written request. Customer understands there is a minimum usage fee for opting to receive a paper bill rather than online/automatic billing (eBill). For Customers who agree to allow CallFreak to bill their charges via eBill, the low usage/paper bill fee will be waived. If Customer requests a toll-free number on their account, a monthly recurring fee per toll free number will be charged in addition to usage. Commercial and residential accounts may be required to pay via credit/debit card if such account is deemed a credit risk. CallFreak performs credit checks on all submitted orders using social security numbers. Should a Customer’s order be rejected due to negative information received from our credit agency, the Customer will receive written notification. Any and all accounts (business or residential) that pay by credit/debit card or via ACH/bank account information may be charged any and all outstanding balances to their financial account at any time. Additionally, accounts using the online billing website may be charged a site maintenance fee. Terms and conditions will be posted on the e-bill website.CallFreak may charge Customer a reasonable fee for research and any resulting paperwork involved in requests for copies of past bills or other documentation.
International Service: Customer understands that the telephone line(s) are activated for international calling. Customer further understands that if telephone lines are tampered with, compromised, lost or stolen, the customer assumes full responsibility for usage on such lines until CallFreak is notified of the undesired usage. It is the customer's sole responsibility to notify CallFreak of any changes in international status regarding telephone lines. The customer agrees to maintain strict security over long-distance lines on the CallFreak network. International call types (mobile, NGN and landline) are rated by foreign, non-U.S. phone companies and are not controlled by CallFreak. International call types and rates are subject to change without notice and a complete list may be obtained from CallFreak upon request. International call types (mobile, landline or NGN) are not disputable by the customer nor will CallFreak re-rate international calls.
Limitations of Liability: Customer understands that CallFreak will use commercially reasonable efforts to provide services; however, CallFreak makes no guarantee that services will be provided and assumes no liability directly or indirectly for interruption of service. Customer acknowledges that CallFreak shall not be liable for any consequential, indirect, special, incidental or other damages whatsoever arising from any failures, interruptions, delays, errors or deficiencies of services, facilities or equipment provided by CallFreak, suppliers, vendors, affiliates, partners and subsidiaries pursuant to your order for service. Since damages would be difficult to determine if your service is disrupted or otherwise negatively affected, Customer agrees to accept a damages fee for each month in which service is disrupted or otherwise negatively affected.
Security: The importance of security for all personally identifiable information associated with You is of utmost concern to us. We exercise great care in providing secure transmission of Your information from Your PC to our servers.
CallFreak's site has security measures in place to protect the loss, misuse and alteration of the information under our control. Normally, we require our users to transmit credit card information for the purpose of sign up or to make changes to their credit card information. In these cases, we transmit that credit card number in an encrypted format using SSL (secure socket layer), the industry-standard. However, e-mail should not be considered as a secure means of communication even when encrypted. The information can only be as secure as the encryption method. In addition, CallFreak has implemented operations guidelines to ensure Customer and Visitor privacy is safeguarded at every level of its organization. CallFreak will continue to revise policies and implement additional security features as new technologies becomes available. However, no system or service can give a 100% guaranty of security, especially a service that relies upon the public Internet. Therefore, you acknowledge the risk that third parties may gain unauthorized access to your information when using our services.
Your CallFreak Account is password protected so that only You can access it and view information relevant to Your account. We recommend that You do not divulge Your password to anyone. TEL3 will never ask You for Your password in an unsolicited phone call or email. Ultimately, You are responsible for maintaining the secrecy of Your passwords and any account information.
Remember to sign out of Your CallFreak account and close your browser window when You have finished Your work. This is to ensure that others cannot access Your personal information and correspondence if Your computer is accessible to others or if You share a computer with someone else or are using a computer in a public place like a library or internet café.
Communications: CallFreak will not read, listen to or disclose to any third parties private e-mail, conversations, or other communications that are transmitted using CallFreak’s services except as required to ensure proper operation of services or as otherwise authorized by law.
The information you send to us may be stored and used to improve this site and our products, or it may be reviewed and discarded. However, your information will only be shared with third parties with your explicit permission.CPNI: In the course of providing services to you, we collect and maintain certain customer proprietary network information ("CPNI"). Registration: The CallFreak registration form requires You to provide contact information (such as name), unique identifiers (address and email address) and demographic information (age), all of which is user profile information. Contact information is used to communicate with You for purposes such as gathering survey information, billing for requested value-added services, notification of service upgrades, and changes to existing services. Unique identifiers (such as e-mail and street addresses) are used to verify Your identity and to set up record system accounts. Additionally, if You choose to purchase products or services You may be asked to provide financial information such as credit card numbers for billing purposes. All financial information is kept confidential. A third party financial institution will be used to process credit card orders. We will never give any information about you to others without your express permission. Our site uses forms in which you give us contact information so you can place orders, request information and make suggestions. We use your customer information only when it will be important for us to contact you regarding changes to our service, our Web site and special offers we think you'll find valuable.
If you decide to switch your long distance service to one of the plans listed, CallFreak or the company you select will ask you for any relevant information needed to switch your service. Your acceptance of these terms: we reserve the right, at our discretion, to change, modify, add, or remove portions from this policy at any time by posting such changes here. You should review this policy regularly for changes, and can easily see if changes have been made by checking the Effective Date below. However, if at any time in the future we plan to use PII in a way that differs from this policy, we will post such changes here and provide you the opportunity to opt-out of such differing uses. For Customers, this Privacy Policy is subject to the CallFreak Terms of Service or other agreements between you and CallFreak. Our service is maintained in the United States of America. By using our services, you authorize the export of PII to the USA and its storage and use as specified in this policy.

Membership
CallFreak Membership ("Membership") is open to U.S. business persons (excluding U.S. territories) at least 13 years of age. By joining the program, you represent that you are at least 13 years of age or older, that you represent your business, and that by using this program you and your business agree to the terms and conditions of the program. Best Buy is not responsible for ensuring that you honor any policies your organization may have concerning loyalty program awards for items purchased using your company?s funds. Your Membership is non-transferable and is subject to present and future program rules. Your Membership is valid at participating CallFreak U.S. Websites and other CallFreak purchase channels. Enrollment begins upon activation. If you make no eligible purchases during a calendar year (January 1 ? December 31), your Membership will automatically expire on the last day of that calendar year.
Earn Points
As a member of the CallFreak Reward program ("Business Member"), earn 1 point ("Point") for every $1 you spend on any purchase when you identify yourself as a CalllFreak Rewards program member. Points will not be earned for purchases made for governmental or educational institutions. Points will post to your account approximately 3 business days from the purchase. No adjustments to your account ("Account") will be made after the actual purchase date. Earn additional Points through special offers and promotions. Points calculations are based upon dollars spent at checkout on purchases. When products are returned, Points will be deducted from your Reward Zone program account for that purchase/return. Points apply only to the first Membership Card used in connection with any purchase. Membership Cards, Points and Reward Certificates ("Certificate(s)") have no cash value. Membership Cards and Points are nontransferable. Lost or stolen Membership Cards will not be replaced. Best Buy is not responsible for communications, including Certificates, lost due to change of address or other contact information. Other restrictions or exclusions may apply.
Get Rewards
For every 50 points you earn in the CallFreak Rewards program, you will be eligible to receive Certificates/Rewards redeemable for products with the same or less value of the Certificate/Reward from our listed Merchants. Certificates are redeemable toward online and phone purchases. Points are automatically deducted from your account every time you redeem a Certificate/Reward. Certificates will be issued electronically approximately 3 business days after reaching the issuance level you choose. Certificates have a dollar value that can be redeem for products equal to or less than the amount of the sum of the Certificates presented for redemption, excluding tax. Certificates may be used in conjunction with most other discounts or offers toward the purchase of products not to exceed purchase amount. Certificates have no cash value and no change will be given for Certificate redemption. Certificates may only be used once. You may be notified of additional ineligible products and services. Lost, stolen, or expired Certificates will not be replaced. Other restrictions or exclusions may apply..
Membership Cancellation, Modification, Expiration and Termination
There is no need to cancel your Membership if you make no eligible purchases during a calendar year, your Membership will automatically expire on the last day of that calendar year.
CallFreak may, at any time, terminate or modify the CallFreak Rewards program and program rules without any further obligations to members.
If your Membership is cancelled or expires, Certificates will be issued for accrued points that remain in the account. Regardless of the Certificate level that you may have chosen to have Certificates issued, Certificates will be issued for any $5 Certificate amount (250 points) that has been earned. 250 points are automatically deducted from your account for every $5 in Certificate value issued to you. Any points that remain in your account that are insufficient to qualify you for a $5 Certificate will be forfeited. Partial Certificates will not be issued.
CallFreak reserves the right to terminate your membership, in its sole discretion.
